I have received your notice claiming excuse by virtue of [Citation of local enactment of UCC $ 2-615], with respect to the installment due to be delivered on [Delivery Date], under our agreement dated [Date of agreement], for the sale of [Type of goods].
By virtue of [Citation of local enactment of UCC $ 2-616(1)], I reject the modification of the agreement as to the installment currently due. Moreover, as this prospective deficiency in your performance substantially impairs the value of the whole agreement, I also reject the balance of our agreement and claim discharge therefrom.
